JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 11-01-2013 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 323, 307 and 504/34 of the Indian Penal Code.

It is alleged that the co-accused Udyanand Paswan pulled the daughter of the informant and started dragging and when the wife of the informant went save her she was also assaulted by co-accused Shyamal Devi, Tilaki Devi, Budhani Paswan and Ramesh Mandal and when the informant went, he was being assaulted by Munni Lal, Udyanand Paswan and Sita Ram Paswan with lathi.

It is submitted by learned counsel for the petitioners that the petitioner was not named in the FIR, his name subsequently sprang up during investigation and the specific accusation has been levelled against FIR named accused when the petitioner filed a case against the informant at earlier point that is the reason for subsequently implicating the petitioner.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araia in connection with Forbesganj P.S. Case No. 234 of 2009, subject to the conditions as laid down under Section 438(2) Cr.P.C.
