2 11-01-2013 Heard learned counsels for the petitioners and the State.
The petitioners are apprehending arrest in Sugauli P.S.
Case No. 202 of 2011 registered for the offences punishable under
Sections 366A, 372 and 373 of the Indian Penal Code pending in
the court of learned Chief Judicial Magistrate, Motihari.
It is alleged against the petitioners that they along with
one Krishna Patel took the minor daughter of the informant to
their house and thereafter the victim went traceless.
It is submitted by learned counsel for the petitioners that
the victim was married with one Firoz and both of them filed Cr.
W.J.C. No. 439 of 2012 where the victim has admitted to have
married with Firoz and considering the same Krishna Patel has
been granted regular bail by this Court vide Cr. Misc. no. 29106 of
2012.
This Court sees no reason for the learned court below
not to consider to give the same privilege to the petitioners if the
Patna High Court Cr.Misc. No.46181 of 2012 (2) dt.11-01-2013

petitioners surrender within a period of six weeks.
With the above observation, this application is,
accordingly disposed off.
Let the order be transmitted to the learned court below
through fax at the cost of the petitioners.
