The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code and sections 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

It is alleged that the husband of the informant was hired as labourer by the petitioners and thereafter he went missing and thereafter when the informant went to inquire, she was abused and ousted from the house.

It is submitted that only on suspicion the accusation has been levelled when no case under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act is made out and the legal notice which was served to the petitioners on behalf of the informant contained in Annexure 3 reflects that it is admitted

on behalf of the informant that her husband was mentally abraised. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail till conclusion of investigation in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Buxar in connection with Koransarai P.S. Case No.40 of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C.
