The petitioner seeks bail in Desari P.S. Case No. 178 of 2013, registered under Sections 25(1-B)A and 26 of the Arms Act. Learned counsel appearing on behalf of the petitioner submits that the petitioner is a student of B.A. Part-II and has no criminal antecedent and has been falsely implicated in this case mere on suspicion. It has also been submitted that the petitioner is in custody since 19.08.2013. It has further been submitted that the alleged recovery of a country made rifle, four live and five empty cartridges was made from outside the house within boundary of the residential house of the petitioner and not from conscious possession of the petitioner.

The allegation of the informant Lalan Prasad S.I., Chandpura police station is that in course of raid of the house of petitioner country made rifle, four live and five empty cartridges was recovered from behind the house within campus of house near boundary.
Considering the facts and circumstances of the case, the petitioner Nirbhay Kumar Prasant @ Tinku is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Desari P.S. Case No. 178 of 2013.
