This application has been filed for restoration of Criminal Miscellaneous No. 27722 of 2009 which stood dismissed for default due to non-compliance of order dated 13.01.2012 passed by this court, whereby two weeks’ time was granted to the petitioners to take steps for fresh service of notice upon opposite party no. 2 under ordinary process as well as registered cover with A/D at the correct and present address, failing which this application stand rejected without further reference to a Bench.

Learned counsel for the petitioners submits that due to misunderstanding order dated 13.01.2012 could not be complied within time but later on the petitioners have filed requisite on 03.09.2013 to send the notice to opposite party no. 2 by both process to comply the order dated 13.01.2012.

On being satisfied with the reasons furnished in this application, the same is allowed and the Criminal Misc. No.

27722 of 2009 is restored to its original file and number, subject to the condition that the order dated 13.01.2012 is fully complied with within two weeks from today, if the same has not been complied with as yet.
