The petitioner is an accused in connection with Sessions Trial No. 262 of 2012 arising out of Saraiyan P.S. Case No. 155 of 2010 registered under Section 376/34 of the Indian Penal Code.
The allegation against the petitioner is to commit rape with the informant, namely, Rajnandani Kumari, carrying her with the assistance of two other co-accused. The prayer for bail of the petitioner has already been rejected vide order dated 21.05.2012 passed in Cr. Misc. No. 11584 of 2012 by this Court. No any fresh ground has been raised in the present petition to consider the prayer for bail.
Under the aforesaid facts and circumstances of the
Patna High Court Cr.Misc. No.40703 of 2013 (2) dt.25-09-2013
case, I am not inclined to grant bail to the petitioner. Accordingly,
the prayer for bail of the petitioner is rejected.
