JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 09-10-2013 Heard learned counsels for the petitioner and the State. Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 468/109 of the I.P.C. It is alleged that Bihar State Credit and Investment Corporation entrusted the petitioner being Secretary of the company for verification of the document of the loanee i.e. M/S Barway Granite and Stone Company Private Limited for disbursement of the loan when after verification the petitioner submitted report on 28.02.1995 that the documents are genuine when the loan was granted to the tune of rupees 56.11 lacs and due to the wrong report submitted by the petitioner, the loan amount could not be recovered.

It is submitted by learned counsel for the petitioner that verification was made in 1995 when the complaint has been filed in 2011.

Considering the delayed lodging of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1^st Class, Patna in connection with Complaint Case No. 2046(C ) of 2011, Trial No. 151 of 2013, subject to the conditions as laid down under Sections 438(2) of the Cr. PC.
