2. The petitioner is in custody since 7.3.2013 in connection with alleged offences under Sections 461, 379 I.P.C. registered in connection with Habibpur P.S. Case No. 13 of 2013.
3. The allegation is with regard to theft committed in the jewelry shop of the informant.
4 . It is submitted that the petitioner has been implicated merely on suspicion, as he was arrested on 7.3.2013 when he was searched along with co-accused Basudeo Singh and iron rods and iron nails were recovered from their conscious possession. It is submitted that the alleged occurrence is of 10.2.2013 and the aforesaid recovery on 7.3.2013 cannot connect the petitioner with the alleged offence. A statement has been made that the petitioner is of clean antecedent.
5. Considering the aforesaid facts, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/-
