Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State.

Petitioner is in jail custody since 31.10.2009 in connection with Sessions Trial No. 41 of 2010 arising out of Banmankhi P.S. Case No. 170 of 1998. Earlier petitioner was granted bail but he misused his privilege of bail as a result of which his bail bonds were cancelled on 03.08.2001 and subsequently, he could be remanded in the aforesaid case on 31.10.2009.

It is informed on behalf of the petitioner that up till now only four prosecution witnesses have been examined and petitioner has sufficiently punished by remaining in jail custody since long for his misconduct.

Considering the aforesaid facts and circumstances as

well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Ad hoc Additional Sessions Judge-VIII, Purnea in connection with Sessions Trial No. 41 of 2010 arising out of Banmankhi P.S. Case No. 170 of 1998 subject to condition that he shall attend the trial court on each and every date in person for the period of one year or till conclusion of his trial whichever is earlier and if he fails to do so on three consecutive dates without any genuine cause, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
