3 20-09-2013 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State.
The petitioner is said to be main assailant and it is stated that he opened fire on the chest of the deceased.
It is submitted that sister-in-law of the petitioner has filed counter case in respect of the alleged occurrence and the petitioner is in jail custody since long but uptill now, his trial has not been concluded.
Considering the allegation levelled against the petitioner, I am not inclined to release the petitioner on bail and, accordingly, his prayer for bail in connection with Sessions Case No. 761 of 2010 arising out of Kasim Bazar P.S. Case No. 77 of 2009 pending in the court of Ad hoc Additional Sessions Judge-IVth, Munger stands rejected.
