Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State.
At the very outset, it is pointed out by learned counsel for the petitioners that the petitioner no.2, namely, Chandan Kumar Singh @ Ritu Raj has already been released by learned Juvenile Justice Board. It is further contended by him that so far as the petitioner no.1 is concerned, according to the prosecution case itself, nothing was recovered from his conscious possession and it is suspected that the petitioners and other accused kept arms and ganja in the house of one Pemchand Kumar against whom, present case was registered.
Considering the aforesaid facts and circumstances as well as submissions of the parties, prayer for petitioner no.2, namely, Chandan Kumar Singh @ Ritu Raj stands dismissed as withdrawn and so far as the petitioner no.1, namely, Singheshwar Singh @ Ram Singar Singh is concerned, he is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the District & Sessions Judge, Vaishali at Hajipur in Jandaha P.S. Case no. 28/2012.
