Petitioner being husband of informant is in jail custody since 27.6.2013 in a case registered under section 498A/34 of the IPC and 3/ 4 of the D.P. Act.

At the very outset, learned counsel for the petitioner submits that the petitioner is still ready to keep the informant with full honour and dignity and it is the informant who does not want to lead her conjugal life with the petitioner.

On the other hand, learned counsel for the informant refuted the above stated submission submitting that informant is also ready to go with the petitioner, if the petitioner wants to keep her with full honour and dignity.

In the aforesaid circumstances, petitioner, namely, Sanjay Kumar Gupta is directed to be released on bail in connection with Giriyak (Katrisarai) P.S. Case No. 41 of 2013 on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to

the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif subject to the condition that after release of the petitioner from judicial custody, the Chief Judicial Magistrate, Nalanda at Biharsharif/ concerned court shall issue notice to the petitioner as well as informant fixing a date for reconciliation and shall explore the possibilities of reconciliation.

It is made clear that if the dispute of the parties is not resolved due to rigid and non-cooperative approach of the petitioner, the learned trial court shall be at liberty to cancel bail bonds of the petitioner.
