Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State assisted by learned counsel for the informant.
Admittedly, petitioner is husband of the concerned mukhiya and annexure 2 to this petition reveals that mukhiya/elected representative has no role in allotting Indira Awas Yojna. Even if it is accepted that petitioner is husband of the mukhiya, then also, wife of the petitioner has also no role in allotting Indira Awas Yojna.
Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Mahua P.S. Case no. 392/2011.
