2 08-10-2013 Heard learned counsels for the petitioner and the State.
Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 307, 323, 379, 387 of the I.P.C.
It is alleged that miscreants took the bottle of the liquor from the shop of the informant but were not ready to make payment when the protest was made then Sahwaz assaulted with iron rod on the head of the informant and thereafter Alisher took Rs. 50,000/- from the cash box of the informant. It is alleged against the petitioner that petitioner took bottle of wine.
It is submitted by learned counsel for the petitioner that accusation of assault is not alleged against the petitioner.

The aforesaid facts constitute ground for consideration of regular bail, if the petitioner surrenders within a period of six weeks in connection with Bettiah Town P.S. Case No. 851 of 2012, pending in the Court of learned Chief Judicial Magistrate, Bettiah at West Champaran.
With the observations above, the application stands disposed off.
Let the order of this Court be transmitted through FAX to the learned Court below at the cost of the petitioner.
