JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 07-10-2013 Heard learned counsels for the petitioner and the State. The petitioner being the own brother of the informant is apprehending arrest in a case registered for the offences punishable under Sections 447, 324, 326, 308 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is of causing firearm injury on the leg of the informant.

It is submitted by learned counsel for the petitioner that the injury has been found to be simple superficial in nature when there is counter version of the occurrence also. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Moreover, the petitioner is ready to deposit Rs. 5,000/- before the learned court below which will be released in favour of the informant.

On deposit of aforesaid amount, let the above named petitioner be released on anticipatory bail, in the event of arrest or

surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Deepnagar P.S. Case No. 63 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
