The petitioner has renewed his prayer for bail in a case registered for the offences punishable under Sections 147, 148, 149, 342, 302,429 of the Indian Penal Code, 27 of the Arms Act and 3 of the Explosive Substances Act.

It is alleged against this petitioner and
one Mritunjay Rai that they caused fire arm injury
on the head of the deceased but only one entry wound
has been found.
The petitioner is languishing in custody
since 01.08.2011 but the report of the learned court
below dated 05.02.2013 reflects that the learned
court below shall try to conclude the trial
preferably within period of six months.

If the trial will not be concluded within
six months from the date of receipt or production of
copy of this order due to no laches on the part of

the petitioner, the petitioner will be liberty to
renew his prayer for bail.

With this observation, the application is
disposed off in connection with Sessions Trial No.
260 of 2012 arising out of Akilpur P.S. Case No. 15
of 2011 pending in the court of the learned A.D.J.
Vth, Danapur, Patna.
