JUSTICE DINESH KUMAR SINGH ORAL ORDER 3 12-02-2013 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in Goraul P.S. Case No. 282 of 2012 registered for the offences punishable under Sections 326, 307 and 380/34 of the Indian Penal Code and Section 27 of the Arms Act pending in the court of learned Chief Judicial Magistrate, Vaishali at Hajipur.
The accusation against the petitioner is of causing firearm injury to the informant.
It is submitted by learned counsel for the petitioner that the injury has been found to be simple when the petitioner was alleged to be armed with pistol when the injury has been found to be caused by gun shot and at earlier point of time, a case was lodged against the informant’s side under Section 498A of the IPC by Nitu Kumari who happens to be cousin of the petitioner.
In view of this Court, it is a case for consideration of regular bail.
