The petitioner is in custody in connection with Motihari Muffasil P.S. Case No. 369 of 2012 for offence punishable under Sections 395 and 397 of the Indian Penal Code, Section ¾ of the Explosive Substance Act and Section 27 of the Arms Act.
The FIR has been instituted alleging dacoity by 12 to 15 members of a group. The name of the petitioner has transpired as one of the mobile looted in the occurrence was being used on his SIM card.
Learned counsel submits that it is only in such circumstance and even in absence of any recovery or T.I. Parade that the petitioner is in custody since 29.12.2012 and has no criminal antecedent.
