Learned senior counsel appearing for the petitioner with reference to the copy of the FIR placed at Annexure-1 has submitted that the allegation is directed against the nephew of this petitioner, namely, Md. Tazmul Haque of having association with the daughter of the informant and which left her pregnant. It is alleged that subsequently the said co-accused Tazmul Haque has taken the daughter of the informant and whereafter she never

returned and the dead body was found in a maize crop field. Learned counsel submits that the reference of this petitioner has occurred during the course of conciliation and in which it is alleged that this petitioner along with other ousted the informant away and refused to have any conciliation. It is submitted that except the said allegation there is no other material to connect the petitioner with the alleged offence.

Taking into consideration the submission of learned counsel and the materials on record, let the petitioner, namely, Tafazul @ Md. Tafezul be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with K.Hat (Maranga) P.S. Case No.46 of 2013.
