Unknown miscreants boarded the pickup van bearing No. BR04D/8777 and after assaulting the driver decamped with their belongings for which on the fardbeyan of Raja Kumar Yadav, the khalasi, the instant case has been registered.
It has been submitted on behalf of the petitioner that no adverse material has been collected against the petitioner during investigation nor he was put on Test Identification Parade as is evident from the order impugned save and expect having his name present in extra judicial statement before the police.
Learned A.P.P. opposes the prayer and has submitted that investigation is still going on.
