learned Additional Public Prosecutor for the State.

Petitioner has been convicted by the learned Judicial Magistrate for the offences punishable under Sections 25(1-b) A, and 26 of the Arms Act and was sentenced to undergo rigorous imprisonment for two years and a fine of rupees two hundred was also imposed upon him for the offence punishable under Section 25(1-b) A of the Arms Act and furthermore, to undergo rigorous imprisonment for one year and a fine of rupees one hundred was also imposed upon him for the offence punishable under Section 26 of the Arms Act.

Learned counsel appearing for the petitioner submits that after judgment of conviction and order of sentence, the petitioner filed bail application before the learned trial court but the leaned trial court refused the bail and after that petitioner

preferred criminal appeal before the learned Sessions Judge vide Cr. Appeal No. 189 of 2012 and prayed for bail but learned appellate court, too, dismissed the bail petition of the petitioner and, accordingly, both the courts violated the mandatory provision of Criminal Procedure Code.

In view of the aforesaid submissions, this petition stands disposed off with direction to learned Additional Sessions Judge-VI, Patna City, Patna to release the petitioner on bail till disposal of the above stated criminal appeal in connection with Agamkuan P.S. Case No. 44 of 2012 forth with after receipt of this order.

Let this order be communicated to the court of Additional Sessions Judge-VI, Patna City, Patna in connection with Cr. Appeal No. 189 of 2012 through fax at the cost of the petitioner.
