Petitioner is in jail custody since 1.11.2012 in a case registered under section 364 of the IPC.

Petitioner is not named in the first information report but his name came in the confessional statement of victim recorded under section 164 of the Cr.P.C. Victim stated that when he was taken to hut of Daroga Choudhary, Daroga Choudhary was talking with miscreants taking their names as Dharmendra and two others.

Learned counsel for the petitioner submits that petitioner is in jail custody since 2007 in connection with other case but when he was acquitted in the said case, police remanded him in the present case. It is also pointed out by him that victim has not disclosed parentage and address of the petitioner but in spite of that petitioner has been remanded in this case and moreover, statement of Daroga Choudhary has not been recorded nor petitioner was put on test identification parade and, as a matter of fact, except criminal

antecedent of the petitioner, there is nothing against him.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in Manjhi P.S. Case no. 34/2007.
