Petitioner is the husband of the complainant. He is apprehending his arrest in a case registered for the offence under Section 498(A) and other allied section of the penal code and under Sections 3 and 4 of the Dowry Prohibition Act.

It is submitted on behalf of the petitioner that he is ready and willing to resume the matrimonial relationship with the complainant and for that purpose he shall be filing an affidavit in the court below within four weeks from the date of receipt/production of a copy of this order in the court below. No sooner the affidavit as indicated above is filed by the petitioner, the petitioner aforesaid be admitted to the provisional bail after furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate (East), Muzaffarpur in connection with Complaint Case No. 1484 of 2012, Tr. No. 2046 of 2012 and notice be issued to the complainant and after her appearance in presence of the court, the petitioner shall again express the resolve to continue the matrimonial relationship with the petitioner after giving her due respect.

In the event, the complainant is back in the matrimonial fold or dispute is settled or she is found to be unreasonable, provisional bail granted to the petitioner be confirmed, failing which the court below shall consider the reasonableness of the stand of the parties and pass appropriate order in the matter including an order to cancel the provisional bail granted to the petitioner.
