JUSTICE MIHIR KUMAR JHA ORAL ORDER 4 09-10-2013 Heard learned counsel for the parties. Having regard to the nature of allegation constituting for offence under Sections 376, 313, 323, 342 and 506/34 of the Indian Penal Code, this Court by taking into account that the age of the girl in the medical examination has been found to be between 15-16 years and thus a minor and her abortion has also been confirmed in such medical report, is not inclined to grant bail to the petitioner. None-the-less since the petitioner is in custody since 15th November 2012 this Court would direct for expeditious trial of the petitioner, specially when learned counsel for the informant has also given assurance to this Court that all the witnesses including the victim girl under the control of informant will be examined without adopting any delaying tactics. This Court would accordingly direct the trial court to conclude the trial of the petitioner within a period of nine months form the date of receipt of this order by conducting trial expeditiously and if need be even on day to day basis.
