Petitioner apprehends his arrest in connection with Complaint case no. 191/2012 in which cognizance has been taken for the offence under section 498A of the IPC.

Learned counsel for the petitioner submits that the complainant is not her legally wedded wife and, as a matter of fact, she is wife of one Mahesh Singh. It is also pointed out by him that enemies of the petitioner set up the complainant and got instituted this case.

On the other hand, learned counsel for the complainant opposes the prayer submitting that, no doubt, earlier marriage of the complainant was solemnized with one Mahesh Singh but after separation from the aforesaid Mahesh Singh the complainant solemnized her marriage with the petitioner and that is the reason this court referred the dispute of the parties before the Patna High Court

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, let the petitioner, Ashok Yadav @ Ashok Kumar, be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Daudnagar, Aurangabad in Complaint Case no. 191/2012 subject to condition as laid down under section 438(2) of the Cr.P.C.
