The petitioner apprehends his arrest in connection with Madhepura P.S. Case No. 369 of 2012 registered under Sections25(i-B), 26, 35 & 27 of the Arms Act.

Admittedly, the petitioner was not caught at the spot and his name surfaced in this case in confessional statement of coaccused who was caught at spot and from whose possession, firearms were recovered. Perusal of the case diary shows that after completion of investigation, police submitted charge sheet for the offences punishable under the provisions of Arms Act. Admittedly, no fire-arms has been recovered from conscious possession of the petitioner and as per submission made on his behalf, the petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as

well as submission of the parties, in the event of arrest or surrender within four weeks from today, let the petitioner, namely, Kanehaya @ Bibek Kumar @ Kanhaiya Kumar be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Madhepura P.S. Case No. 369 of 2012 to the satisfaction of Chief Judicial Magistrate, Madhepura subject to conditions as laid down u/S 438(2) of the Cr.P.C.
