3 17-06-2013 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State.

Petitioner no. 1 is elder brother in law whereas petitioner no. 2 is Gotini of the deceased and both the aforesaid petitioners apprehend their arrest in connection with Rafiganj P.S. Case No. 176 of 2012 registered for the offence punishable under Section 304B/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that as a matter of fact, deceased died of her natural death and information regarding her death was properly given to the informant who came having got the aforesaid information and the dead body of deceased was cremated in presence of the informant. Learned counsel for the petitioners also drew my attention towards the Annexure-2 to this petition.

admitted this fact that he got information regarding the death of deceased on phone said to be given by family members of the petitioners.

Considering the aforesaid facts and circumstances as well as submissions of the parties, the prayer for anticipatory bail of petitioners is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Rafiganj P.S. Case No. 176 of 2012 subject to condition as laid down under Section 438(2) of the Cr.P.C.
