Same was the position on 30.5.2013 when this Court passed over the matter observing that on the next occasion if none appears to press the petition, the petition shall proceed on its own merit. Petitioner is apprehending his arrest in connection with a case registered for the offence under Section 307/34 of the Penal Code and 27 of the Arms Act. He is named in the First Information Report. There is omnibus allegation of assault against those named in the First Information Report. It is submitted on behalf of the petitioner that the licensed gun of those named in the First Information Report was subjected to test whereafter it was confirmed that the said gun was never used. It further appears from the petition that there is a preceding land dispute between the parties. From paragraph 18 of the petition it appears that besides the present case petitioner is accused in one another case under Section 304B of the Penal Code lodged by his father-in-law vide Mufassil P.S. Case No. 123/2006.
