ORAL ORDER
3 03-06-2013 Heard learned counsel for the petitioner and the State.
Petitioner is apprehending his arrest in connection with
a case registered for the offence under Section 47(A) of the Excise Act
on the allegation that from a Sumo vehicle 600 litres of unauthorized
liquor was being unloaded. Petitioner is neither the owner of the
vehicle nor the shop in which the liquor was to be kept.
In the circumstances, the petitioner (named above) is
directed to surrender in the court below within four weeks from the
date of receipt/production of a copy of this order in the court below
and thereafter he be admitted to the privilege of bail on furnishing
bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like
amount each to the satisfaction of C.J.M., Kaimur at Bhabua in
connection with Excise Case No. 39/2012, subject to the conditions
as laid down under Section 438(2) of the Cr.P.C.
