Having regard to the fact that though there was direct allegation of committing offence u/s 302 I.P.C. against the petitioner in the FIR to have caused the death of the deceased by causing fire arm injury, the post mortem report does not reflect any injury of fire arm on the person of the deceased. That apart from paragraph no. 6 of the case diary, it would also transpire that the informant in course of her further statement did not support the allegation made against the petitioner in the FIR as with regard to his causing fire arm injury.
