Having regard to the admitted position that the petitioner was not made accused in the First Information Report containing name of at least seventeen persons in relation to the offence under Section 302 and the allied provisions under Indian Penal Code and that the name of the petitioner had surfaced only subsequently, this Court, keeping in view that the other co-accused persons namely Shankar Kharwar, Santosh Singh, Choote Mian, Ashok Kharwar, Sheo Murat Singh and Nakharu Kharwar having identical allegations have already been granted bail (as is mentioned in the report of the Stamp Reporter), is inclined to grant bail to the petitioner specially when he claims to have already been granted bail in seven other cases in which he had been made accused.
