Not only the look of this case is bad, inasmuch as, the daughter of the petitioner marrying against the wishes of the petitioner has been subjected to episode of honour killing and her husband as well as two children have been done to death but from the perusal of the case diary, it is the petitioner who is found to have given the fatal gun shot injury on the person of the husband of his daughter.
The submission of Mr. Suraj Narain Pd. Sinha, learned Senior counsel appearing on behalf of the petitioner that the daughter, the informant, had definitely not named the petitioner in the First Information Report as main assailant of her husband would in no way take away the veracity of the

materials collected in course of investigation wherein a number of persons including Lal Bahadur Bind in paragraph no. 34 of the case diary has clearly stated about the petitioner giving fatal gun shot injury on the person of Dinaru Bind, the husband of informant-daughter. From paragraph no. 107 of the case diary it is also found that that there is a corresponding gun shot injury on Dinaru Singh as opined by the Doctor in the post mortem report.
Considering all these aspects, this Court is not inclined to grant bail to the petitioner. The prayer for bail of the petitioner is accordingly, rejected.
