| petitioner has been granted anticipatory bail with a condition that petitioner shall surrender in the court below within a period of four weeks from the date receipt of copy of this order and after his surrender the court below shall call the complainant and if the complainant is ready to live with the petitioner then petitioner shall be enlarged on bail. Further condition that if the complainant refused to live along with the petitioner, in that case, the petitioner shall be physically present on each and every date fixed in the case and any absence without valid and reasonable cause the bail bond of the petitioner shall automatically stand cancelled. It is further submitted that there is no specific order with regard to when petitioner will surrender and till the appearance of the complainant after calling the complainant the court bellow whether petitioner will be released on bail or taken into custody. |

In such exigency petitioner shall be released on interim bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran, Bettiah, in connection with Yogapatti (Sanichary) P.S. Case No. 134 of 2011 and on being satisfaction of the condition trial court shall confirmed the bail bond of the petitioner.
However, the period of surrender of the petitioner in the court below shall be extended for a further period for four weeks from the date of receipt of copy of this order.
To that extent the period of surrender is extended for a further of period of four weeks is modified.
This application thus disposed of.
Let the order be communicated to the court below through FAX at the cost of the petitioner.
