Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.
Petitioner is husband of the deceased and according to the prosecution case itself, deceased was residing at her parental house at the time of alleged occurrence.
It is alleged that the petitioner confessed his guilt and admitted this fact that he administered poison to the deceased and also gave dagger blow on the chest of mother of the deceased.
Para 49 of the case diary reveals that mother of the deceased sustained simple injury and so far as administration of poison to the deceased is concerned, except confessional statement of the petitioner, there appears to be nothing against him.
Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Adhoc. Addl. Sessions Judge III, Purnea in Sessions trial no. 1355/2012 arising out of Barhara P.S. Case no. 126/2012.
