The petitioner has approached this Court for a direction to the Respondents to estimate the need based posts and final restructuring different grade of 4048 posts including 198 posts of Registrars grade of Bihar Secretariat Service and for promoting the petitioner to the post of Deputy Secretary and Director in rank of Joint Secretary.

On 12.10.2012 two weeks time was granted to the State to file counter affidavit, but some more time is sought as counter affidavit could not be prepared owing to Durga Puja

holidays. The petitioner on the other hand objects to further time being granted to the State for filing a counter affidavit as the matter would be further delayed.

With consent of the parties, accordingly, this writ petition is being disposed of at this stage itself without entering into the merits of the matter, with a direction to the concerned respondents to consider and dispose of the petitioner’s representation dated 25.7.2012 and 14.9.2012 said to have been filed by the petitioner and pending. Considering that over two years have already elapsed since the meeting of the high level Committee on 29.6.2010 it is expected that the matter will be considered expeditiously and in any event within a period of three months from the date of receipt/production of a copy of this order.

With the above observations and directions the writ petition stands disposed of.
