Learned counsel for the Customs Department points out that decision of the Adjudicating Authority, as contained in Annexure-6, is in favour of the petitioner. Hence, seized goods might have been released in his favour. Even if the Department decides to file an appeal against the said order, petitioner has remedy to get his seized goods released under Section 110 A of the Customs Act, 1962.
Since learned counsel for the petitioner is not present in Court today also, this application is dismissed as not pressed.
