JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 19-10-2012 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in Singhia P.S. Case No. 79 of 2011 registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code pending in the court of learned Addl. Chief Judicial Magistrate, Rosera at Samastipur.
The accusation is of kidnapping the minor daughter of the informant by Chandan Kumar Singh in conspiracy with the petitioner. In 164 Cr. P.C. statement, the victim got her age recorded as 16 years when the court assessed her age as 14 years where she stated that she was being abducted by the petitioner and Chandan Kumar Singh.
In view of this Court, it is fit case for consideration of regular bail.
