This is a petition for grant of regular bail in a case under Section 394 of the Indian Penal Code.

Learned counsel for the petitioner submits that the co-accused Sikki Jha @ Sugandh Jha has been granted bail as apparent from the impugner order. No specific overt act has been alleged against the petitioner that what act of commission and omission done by him and has only stated that the informant identified in the light of another vehicle and named three persons and nothing has been recovered from the possession of the petitioner.

Learned counsel for the petitioner further submits that one more case for the offence under Section 379 of the Indian Penal Code is pending against the petitioner.

Hence, having regard to the facts and circumstances of the case, the petitioner above named is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of

the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Lodipur P. S. Case No. 12 of 2012, subject to the condition that one of the bailors shall be the near relatives of the petitioner who shall file affidavit to the effect that the petitioner has two cases including this case and one more case for the offence under Section 379 of the Indian Penal Code and the petitioner has no other case and further the petitioner shall appear in the case on each and every date fixed by the court below and any absence of the petitioner shall be subject to the satisfaction of the court below on reasonable grounds.
