Heard learned counsel for the petitioner and the State. This is a petition for grant of regular bail for offence under Section 392 of the Penal Code.

The petitioner has not been named in the first information report. However, it is stated that a mobile has been recovered from the possession of this petitioner.
The learned counsel for the petitioner submits that seizure list though suggests that on 20.03.2012 it has been prepared, but, the witnesses have singed on it on 21.03.2012. It has, further, been submitted that the looted mobile has not been recovered from the possession of the petitioner and whatever recovered has been recovered on the confessional statement of the co-accused. The petitioner is in jail since 22.03.2012.
Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Shikarpur P.S. Case No. 53 of 2012 to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran.
