JUSTICE DINESH KUMAR SINGH ORAL ORDER 3 08-11-2012 Heard learned counsels for the petitioner, Vigilance and the State. Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 13(2) read with 13(1)(e) of the Prevention of Corruption Act.

The petitioner joined as Assistant Engineer in the government of Bihar in 1960 when he superannuated from the post of Superintendent Engineer in 1996 when the case was registered in 2004. The disproportionate assets to the known sources of income has been assessed by the vigilance is to the tune of Rs. 77 lacs when charge-sheet has been submitted.

The contention of the counsel for the petitioner that charge-sheet has been submitted in 2012 has not been controverted by learned counsel for the vigilance. This is also not the case of the vigilance that petitioner has not cooperated

during the investigation.

Considering the aforesaid facts, let the petitioner namely Hira Kant Jha, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance, 1, Patna in connection with Special Case No. 19 of 2004, arising out of Vigilance P.S. Case No. 17 of 2004.

The bail bonds of the petitioner will be accepted on filing affidavit that he will cooperate in the investigation. Let the aforesaid affidavit be transmitted to the concerned I.O. by learned Court below.

Non-cooperation in the investigation will give liberty to the prosecution to file appropriate application for cancellation of bail of the petitioner.
