ORAL ORDER
2 07-11-2012 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 325, 307, 504, 506 of the I.P.C.
It is alleged that one Manish Kumar being student of Magadh Engineering College was assaulted by the petitioner and 15 to 20 people.
It is submitted by learned counsel for the petitioner that accusation is of making assault by 20-25 people when injury report reflects only one bruise of temporal region which has been found to be grievous when it is orally submitted that petitioner has no criminal antecedent and due to some petty dispute between the students, the occurrence took place when petitioner is also the student of the Magadh Engineering College.
Considering the same, let the petitioner namely

Naushad Alam @ Md. Nausad Alam @ Md. Naush Alam, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Khizer Sarai P.S. Case No. 159 of 2011.
The bail bonds of the petitioner will be accepted on filing affidavit that he will cooperate in the investigation. Let the aforesaid affidavit be transmitted to the concerned I.O. by learned Court below.
Non-cooperation in the investigation will give liberty to the prosecution to file appropriate application for cancellation of bail of the petitioner.
