JUSTICE DINESH KUMAR SINGH ORAL ORDER 3 01-08-2012 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 409 and 420/34 of the Indian Penal Code.
The accusation is of withdrawing rupees sixty one thousand from the joint account under the signature of Headmaster with regard to construction fund of the school.
It is submitted that subsequently the BDO transmitted a letter to the District Programme Officer on 24.2.2012 to the effect that subsequently the work has been done with the withdrawn money and the consequential letter was issued by the District Programme Officer to the I.O. vide memo no. 1687 dated 27.4.2012.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve
