JUSTICE DINESH KUMAR SINGH ORAL ORDER 3 03-08-2012 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,386,379,414,504 and 506/34 of the Indian Penal Code and section 27 of the Arms Act.

It is alleged that for payment of extortion amount of Rs.200000 the construction work was stopped by accused persons when Rs.30000 was realized by accused Satish Sharma on pistol point.

It is submitted that the accusation against the petitioner is not specific when the uncle of the petitioner lodged a case vide Makhdumpur P.S. Case no. 66 of 2006 against the informant under section 307 IPC in which trial is going on, hence the present case has been lodged. Statement has been made in the paragraph 15 petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Makhdumpur P.S. Case No. 262 of 2011 subject to the conditions as laid down under Section 438(2) Cr.P.C.
