Heard learned counsel for the petitioners and learned Addl. Government Advocate for the State.

The petitioners have approached this Court with the

following prayer:

“Under these circumstances, the petitioner most humbly prays that this Hon’ble Court be graciously pleased to issue a Rule NISI calling upon the Opposite Parties to show cause as to why;

i. the Opposite Parties shall not be directed to mutate the subject matter property in the name of the Petitioners in Mutation Case No. 2664 of 2025, in accordance with order passed dated 24.04.2026 in T.S. No. 29/2002-1 by the learned Civil Judge (Jr. Division), Nilgiri, and order dated 13.09.2023 of this Hon’ble Court in W.P.(C). No. 3466 of 2015.

ii. That the inaction on the part of the Opposite Parties in not deciding Mutation Case No. 2664 of 2025 shall not be declared arbitrary, illegal and unsustainable in the eyes of law.

If the Opposite Parties fail to show cause or show insufficient cause the Rule be made absolute.

And for the said act of kindness, the petitioner shall as in duty bound ever pray.”

The Petitioners have preferred Mutation Case No. 2664 of 2025 before the Tahasildar, Oupada (Opposite Party No.3). In the present Writ Petition, he seeks a direction to the Opposite Party No.3 for early disposal of the Mutation Case.

Considering the innocuous prayer, the Writ Petition is disposed of directing the Opposite Party No.3 to dispose of the above referred Mutation Case as early as possible, preferably within two months from today.
