Heard learned counsel for the petitioners and learned Addl. Government Advocate for the State.

The petitioners have approached this Court with the following

prayer:-

“Under the above facts and circumstances, it is therefore humbly prayed that this Hon’ble Court may graciously be pleased to issue rule NISI calling upon the Opp. Parties to file show cause as to why rent shall not be collected from the petitioners’ property under annexure-1 and if the opp. parties failed to file show cause or shown insufficient cause the Rule may made absolute against the opp. parties.

And issue any other order/orders writ/writs direction/directions as the Hon’ble Court shall deem fit and proper.

And for this act of kindness the petitioners shall as in duty bound shall ever pray.”

Chandra Ojha, who was the father of the petitioners. After his death, the present petitioners wanted to pay revenue rent but the same is not being accepted. Non-acceptance of the rent is presumably for the fact that the land pertains to be recorded in the name of the father of the petitioners.

Be that as it may, there should be no difficulty in acceptance of the rent as rent can be paid by any person with reference to the Khata number of land in question.

The writ petition is therefore, disposed of directing the Tahasildar, Dharmasala to ensure that the rent paid by the petitioners in respect of the Khata in question is accepted. It shall also be open to the petitioners to seek correction of the ROR, if so advised.
