Since both the BLAPLs relate to the same P.S. (Nirakarpur P.S. Case No.47 of 2026), on the consent of the learned counsel for the Petitioners and learned counsel for the State, they are taken up together and disposed of by this common order.

Heard learned counsel for the Petitioners and learned counsel for the State.

The Petitioners are accused in connection with G.R. Case No.122 of 2026, pending on the file of the learned NGN-cum-JMFC, Tangi, arising out of Nirakarpur P.S. Case No.47 of 2026 for alleged commission of offences under Section 303(2) of BNS. 4. The case of the Prosecution case is that on 06.02.2026, the complainant ASI S.K. Behera reported that at about 06:05 PM while he along with other P.S. staff were performing patrolling duty, they detected a blue and black colour Hero Glamour motorcycle coming from Puri towards Rameswar on New Jagannath Road

near Nirakarpur College Chhak. The rider of the motorcycle was not wearing a helmet. When the complainant gave a signal to stop the M/C, the rider attempted to flee from the spot. He was immediately chased and detained. On demand, the rider failed to produce any documents relating to the motorcycle. He disclosed his name as Sanatan Pradhan @ Nanda. He could not produce any document in support of his ownership of the said motorcycle, and therefore the vehicle was suspected to be stolen property. Accordingly, the Hero Glamour motorcycle bearing Registration No. OD-33-H-7665 was seized in the presence of witnesses. Hence, the case has been registered and investigation is taken up.

Learned counsel, on instruction, submits that except the present BLAPLs, no other bail applications of the Petitioners relating to the aforementioned P.S. case is pending in any other Court. 6. Being aggrieved by the rejection of their application for bail U/s.483 of BNSS by the learned 2^nd Addl. Sessions Judge, Khurda by order dated 20.02.2026 in the aforementioned cases, the present BLAPLs have been filed.

It is submitted by the learned counsel that the Petitioners in BLAPL Nos.2037 of 2026, 2152 of 2026 & 2315 of 2026 are in custody since 06.02.2026 and the Petitioner in BLAPL No.2156 of 2026 is in custody since 07.02.2026.

Taking into account the allegations as noted and in view of the filing of the charge sheet, learned counsel submits that the Petitioners may be released on bail.

Learned counsel submits that the allegation against the Petitioner in BLAPL No.2156 of 2026 is that of a receiver.

Learned counsel for the State opposes the prayer for bail inter alia on the ground that the Petitioners have criminal antecedent.

Considering the nature of allegations, filing of the charge sheet and keeping in view the punishment prescribed qua the period of detention, this Court directs the Petitioners to be released on bail on such terms to be fixed by the learned Court in seisin.

Additionally, it is directed that Petitioners shall appear before the jurisdictional police station one every month on such date and time to be fixed by the learned Court in seisin till conclusion of trial. Certification of such appearance shall be submitted to the Court in seisin.
