01. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in connection with C.T. Case No.05 of 2026, pending on the file of learned J.M.F.C., Kesinga, arising out of Kesinga P.S. Case No.05 of 2026 for commission of the alleged offence under Section 309(6) of BNS.

Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. case is pending in any other Court.

Being aggrieved by the rejection of his application for bail U/s.483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) by the learned Sessions Judge, Bhawanipatna by order dated 29.01.2026 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the Petitioner that taking into account the nature of allegations and that the Petitioner is in custody since 08.01.2026 and the filing of the charge sheet and the basis of accusation prima facie being on account of the co-accused statement, he may be released on bail.

Learned counsel for the State opposes the prayer for bail.

Considering the nature of allegations qua the Petitioner as noted above, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned Court in seisin.

Additionally, it is directed that Petitioner shall appear before the jurisdictional police station once every month on such date and time to be fixed by the learned Court in seisin for the next three months. Certification of such appearance shall be submitted to the Court in seisin.
