Since these four bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties.

These are bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Tigiria P.S. Case No. 76 of 2023 corresponding to C.T. Case No. 74 of 2023 pending in the file of learned J.M.F.C., Tigiria, for commission of offence punishable U/Ss.147/148/341/323/325/326/307/302/354/294/506

/ 149 of IPC r/w. Sec.25 and 27 of the Arms Act, on the main allegation of committing rioting, along with coaccused persons being armed with deadly weapons and committing murder of the deceased by entering into conspiracy with each other in prosecution of their common object.

Heard, Mr. Soura Chandra Mohapatra, learned Senior Counsel, who is being assisted by Mr. Manas Milan Padhi, learned counsel for the petitioner in BLAPL No. 1028 of 2026, Mr. Dillip Kumar Mohaty, learned counsel for the petitioners in BLAPL Nos. 1420, 1561 & 1649 of 2026 and Mr. P. Satpathy, learned Addl. PP in these matters and perused the record.

After having considered the rival submissions upon perusal of record, there appears allegation against the petitioner-Prasanta Nayak @ Prashant Kumar Nayak for entering into conspiracy with co-accused; and against rest of the petitioners for committing rioting and murder of the deceased, but the name of the petitioner-Nanda Behera does not figure out in the FIR. Besides, the FIR has been lodged against 23 persons for committing murder of the deceased, but the investigation is going on. The allegations against the petitioners are not only serious, but also grave, but since the investigation is going on and there appears allegation against the petitioners for committing the crime by entering into conspiracy with co-accused persons, this Court does not consider it proper to grant bail to any of the petitioners at this stage.

Hence, these four bail applications of the petitioners namely Prasanta Nayak @ Prashant Kumar Nayak (BLAPL No. 1028 of 2026), Nanda Behera (BLAPL No. 1420 of 2026), Dipu @ Deepak Pradhan (BLAPL No. 1561 of 2026), Balia @ Balaram Behera @ Sripati Pradhan @ Shreepati Pradhan (BLAPL No. 1649 of 2026) stand rejected. Accordingly, these BLAPLs stand disposed of. A soft copy of this order be immediately transmitted to the Court in seisin over the matter for reference.
