These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Bellagaon PS Case No.87 of 2024 corresponding to ST Case No.230 of 2025 pending in the file of learned Additional Sessions Judge, Chatrapur, for commission of offences punishable U/Ss.126(2)/296/117(2)/109/351(2)/ 3(5) of BNS, on the main allegation of assaulting the injured Kailash Das by means of an Aluminum bucket on his head, along with co-accused persons in furtherance of their common intention.

Heard, Mr. Rajendra Narayan Rout, learned counsel for the petitioner in BLAPL No.219 of 2026, Mr. Soubhagya Kumar Dash, learned counsel for the petitioner in BLAPL No.1037 of 2026 and Mr. S.C. Pradhan, learned Additional Public Prosecutor in these matters and perused the record.

After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-a-vis the

accusations sought to be brought against them and regard being had to the pre-trial detention of the petitioners in custody since 19.08.2025 with submission of charge-sheet in the meantime and taking into account the other circumstances on record in entirety including the inherent right of the accused to be presumed innocent until proven guilty at the trial and keeping in view the grant of bail to co-accused namely Narayan Das in BLAPL No.8625 of 2025, this Court without expressing any view on merits admits each of the petitioners to bail.

Hence, these two bail applications of the petitioners namely Shyam Das (In BLAPL No.219 of 2026) and Surendra Das @ Manua (In BLAPL No.1037 of 2026) are allowed and each of the petitioners is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty-five Thousand) with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it.

Accordingly, these BLAPLs stand disposed of. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
