This is a bail application U/S.483 of the BNSS by the petitioners for grant of bail in connection with Cyber Crime & Economic Offences, Angul PS Case No.29 of 2025 arising out of GR Case No.1297 of 2025 pending in the Court of learned JMFC, Banarpal, for commission of offences punishable U/Ss.318(4)/319(2) of BNS r/w Section 66(D) of IT Act, on the main allegation of committing fraud by defrauding different persons of their investment by collecting the same from them.

Heard, Mr. T. Dhiren Kumar Dora, learned proxy counsel appearing on behalf of Sanjeeb Kumar Mishra, learned counsel for the petitioners and Mr. S.C. Pradhan, learned Additional Public Prosecutor in the matter and perused the record.

After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-à-vis the accusations sought to be brought against them and regard being had to the pre trial detention of the petitioners in custody since 11.12.2025 with submission

of preliminary charge-sheet in the meantime and there being no specific allegation against the petitioner for dealing with the money of the informant and keeping in view the other circumstances on record in entirety including the inherent right of the accused to be presumed innocent until proven guilty at the trial, this Court without expressing any view on merits admits each of the petitioners to bail.

Hence, the bail application of the petitioners stands allowed and the petitioners are allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) each with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following condition:-

(i) the petitioners in the course of trial shall attend the trial Court on each date of posting without fail unless their attendance is dispensed with. In case the Petitioners fail without sufficient cause to appear in the Court in accordance with the terms of the bail, the learned trial Court may proceed against the Petitioners for offence U/S.269 of BNS, 2023 in accordance with law.

Accordingly, the BLAPL stands disposed of. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
